Review the rules of the road for accessing the Mondosa Motors LLC platform, including the content and products therein.

Introduction


These Terms of Use (“Terms”) constitute a legally binding agreement between you and Mondosa Motors LLC, its affiliates setting forth Mondosa Motors LLC obligations to you, and your obligations to Mondosa Motors LLC in relation to your access and use of Mondosa Motors LLC websites and widgets (collectively, “Sites”); and our mobile phone, tablet, and other smart device applications (collectively, “Applications”). The Sites and Applications are collectively referred to in these Terms as the “Mondosa Motors LLC Platform.” In these Terms, “we,” “us,” and “our,” refer collectively to Mondosa Motors LLC.

These Terms, our Privacy Statement terms, our Mobile Applications terms and any additional terms you have agreed to by using specific components of the Mondosa Motors LLC Platform (e.g. online account registration access conditions, online credit application customer agreements), make up the entire agreement between you and Mondosa Motors LLC related to your use of the Mondosa Motors LLC Platform. These Terms do not alter the terms of any other agreement you may have with us unrelated to your use of the Mondosa Motors LLC Platform.

By accessing and using the Mondosa Motors LLC Platform, you affirm that you are at least 18 years old or have parental or guardian permission to use the Mondosa Motors LLC Platform and that you are fully competent to enter into this agreement with Mondosa Motors LLC. You further agree that you will not use the Mondosa Motors LLC Platform for any unlawful or fraudulent purpose or in any manner inconsistent with these Terms. You further warrant that you will not violate or attempt to violate the security of the Mondosa Motors LLC Platform, including without limitation: (i) accessing data not intended for you or logging onto a server or an account that you are not authorized to access; (ii) trying to change the appearance, features, or functionality of the Mondosa Motors LLC Platform; (iii) attempting to probe, scan, or test the vulnerability of a system or network, or to breach security or authentication measures; (iv) attempting to interfere with or interrupt in any way service to any user, host, network, or system including, without limitation, infecting, overloading, “flooding,” “spamming,” “mailbombing,” “crashing” or otherwise attacking the Mondosa Motors LLC Platform  or (vi) sending communications on behalf of the Mondosa Motors LLC Platform (i.e., impersonating Mondosa Motors LLC). If you do not agree to these Terms, then do not use the Mondosa Motors LLC Platform.

Use of the Mondosa Motors LLC Platform

Use of the Mondosa Motors LLC Platform requires a computer, mobile phone, tablet, or other smart device with a compatible browser and internet access. Some Applications require internet, vehicle, or other smart device connectivity in order to function properly. The information and materials on the Mondosa Motors LLC Platform are intended for use in the United States and Puerto Rico. Mondosa Motors LLC makes no representations with respect to the usability of the Mondosa Motors LLC Platform anywhere else. The Mondosa Motors LLC Platform may contain references to products and services that are not available or are prohibited in your country. If you access the Mondosa Motors LLC Platform from outside the United States and Puerto Rico, you are responsible for complying with applicable laws. Further, the privacy protections afforded by the Mondosa Motors LLC Platform may differ from those of your resident country.

Account Registration

Certain features of the Mondosa Motors LLC Platform may require you to register an account. You are responsible for maintaining the confidentiality of your account and password. You may not share your account information with others or allow others to login to your account using your credentials. You agree to accept responsibility for all activities that occur under your account or password. You agree to immediately notify Mondosa Motors LLC of any unauthorized use of your account. Mondosa Motors LLC reserves the right to terminate your account with or without cause.

Your Content

Any material, information, or idea you develop or transmit through the Mondosa Motors LLC Platform by any means, including the “Build Your Own” tool, will be treated as non-confidential and non-proprietary, and may be disseminated or used by us for any purpose whatsoever, including, but not limited to, developing, manufacturing, and marketing products.

Our Content

The Mondosa Motors LLC Platform is operated by Mondosa Motors LLC, and all material on the Mondosa Motors LLC Platform is protected intellectual property owned and controlled by Mondosa Motors LLC. All content included in or made available through the Mondosa Motors LLC Platform, including, but not limited to, text, graphics, logos, icons, and images, is the property of Mondosa Motors LLC or its content suppliers and is protected by United States and international copyright, patents, and trademark laws.

No license to or right in any such copyrighted materials, patents, trademarks, trade secrets, technologies, products, processes and other proprietary rights of Mondosa Motors LLC, or any other third party is granted to or conferred upon you. Downloading, copying, transmitting, using framing or mirroring techniques, reproducing, duplicating, storing, linking to, or otherwise exploiting any content from the Mondosa Motors LLC Platform is expressly prohibited.

Our Products

All illustrations and specifications presented through the Mondosa Motors LLC Platform are for informational purposes only.  Some vehicles may be shown with equipment that is unavailable in the United States and other vehicles may be shown with optional equipment. We reserve the right without prior notice to discontinue or change specifications on products and services offered through the Mondosa Motors LLC Platform.

All prices shown are based upon Suggested Market Retail Price in U.S. dollars and do not include extra costs, including, but not limited to taxes, title fees, dealer charges, options, and destination.

The Mondosa Motors LLC Platform contains links to other websites, including, partner websites, social media websites, event websites, and other third parties and companies whose trademarks may appear on the Mondosa Motors LLC Platform. We are not responsible for the information collection practices or the content of the websites to which we link. You should be aware that, unless otherwise indicated, these Terms do not govern third-party websites you visit, including those that may be hyperlinked for convenience. We encourage you to review the applicable terms and policies of any third-party website.

Mondosa Motors LLC MAKES NO WARRANTY CONCERNING THE DELAY, FAILURE, INTERRUPTION, OR CORRUPTION YOU MAY EXPERIENCE VIEWING OR USING ANY CONTENT, SOFTWARE, FUNCTIONS, SERVICES, MATERIALS, OR INFORMATION (“CONTENT”) TRANSMITTED IN CONNECTION WITH THE USE OF THE Mondosa Motors LLC PLATFORM. Mondosa Motors LLC FURTHER MAKES NO WARRANTY WITH RESPECT TO SUPPORT FOR THE Mondosa Motors LLC PLATFORM. Indemnification

You agree to defend (with counsel subject to Mondosa Motors LLC’s approval), indemnify, and hold harmless: Mondosa Motors LLC, its officers, directors, employees, agents, licensors, and service providers, and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms, your improper use of the Mondosa Motors LLC Platform, or your breach of any laws or regulations.

Disputes

These Terms shall be governed by and construed in accordance with the laws of State of Georgia. Any dispute arising from these Terms shall be resolved exclusively in the state and federal courts of the State of Georgia, without regard to any conflict of law provisions. You hereby agree that any and all legal claims concerning your use of the Mondosa Motors LLC Platform must be commenced within one (1) year after the claim or cause of action arises or they will be time-barred. If for any reason a court of competent jurisdiction finds any provision of these Terms, or portion thereof, to be unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of these Terms, and the remainder of these Terms shall continue in full force and effect.

Modifications

We may modify these Terms at any time. All updates and amendments are effective immediately upon notice, which we may provide by any legal means, including, but not limited to, by posting a revised version of these Terms or other notice on the Mondosa Motors LLC Platform. Continued use of the Mondosa Motors LLC Platform post-modification constitutes your agreement to be bound by the modified Terms.

This Privacy Statement does not address sold connected vehicle services privacy practices, please refer to the manufacture. Our sold connected vehicle services privacy practices are addressed we refer you to the manufacture. Our sold smart device applications also contain additional privacy information about specific application functionalities, which we refer you to the manufacture. 

The Mondosa Motors LLC Platform is targeted to individuals in the United States and Puerto Rico. If you access the Mondosa Motors LLC Platform from other regions, be aware that the privacy practices of Mondosa Motors LLC may differ from those of your home country. By interacting with the Mondosa Motors LLC Platform, you are accepting the terms of this Privacy Statement. If you do not accept the terms of this Privacy Statement, do not use the Mondosa Motors LLC Platform.

Information You Provide to Us

Some features of the Mondosa Motors LLC Platform ask you to provide us with specific categories of information in order to enjoy complete functionality. If you do not provide us with the categories of information requested, your ability to fully interact with the Mondosa Motors LLC Platform may be limited. The features requiring you to provide information to Mondosa Motors LLC are described in detail below:

Inquiries

In order to submit inquiries through the Mondosa Motors LLC Platform, you must provide certain information. The “Contact a Dealership,” “Schedule a Test Drive,” and “Request a Quote,” forms require you to provide your name and email address. This information is required so that you can be contacted about your request. Some Mondosa Motors LLC Platform forms also require you to provide us with your geographic region or zip code so that we can direct your request appropriately.

The “Apply for Credit” form requires you to provide your name, address, date of birth, phone number, email address, social security number, and employment information. This information is required in order to determine your creditworthiness and to notify you of the results of your credit application.

Sweepstakes, Promotions, Contests & Surveys

In order to participate in sweepstakes, promotions, or contests on the Mondosa Motors LLC Platform, you are required to provide personal information such as your name, street address, email address, and date of birth. We require this information in order to administer the sweepstakes, promotions, and contests, to ensure participants meet applicable eligibility requirements, and to contact winners.

You may be asked to participate in surveys about your experience with the Mondosa Motors LLC Platform. When participating in surveys, any information you provide in the comments field will be shared with us, so please do not include any sensitive personal information or other information you do not wish to share.

Placing an Order

When you place an order or reserve a vehicle on the Mondosa Motors LLC Platform, you are required to provide information necessary to fulfill that order or secure your deposit, including your name, address, phone number, and payment information. We use a third-party service to process orders, deposits, and payments. For more information, please review the “Information Sharing” section of this Privacy Statement.

Account Registration

When you register for an account with our Sites or our Applications, you must provide your name and email address. You also have the option to allow Mondosa Motors LLC to contact you with information about products or services that may be of interest to you. Once your account is established, you have the option to provide us with additional information such as your address and phone number so that we can pre-populate forms on the Mondosa Motors LLC Platform when you are logged in. You will also have the ability to save vehicle configurations and inventory favorites in your account. We store that information for as long as your account is active.

You may modify your accounts at any time by visiting the “Profile” settings and making changes to individual fields. You may delete your account at any time by using the “Delete My Account” link in your profile settings. Or you can contact us to modify or delete your account.

Applications

When you use our Applications, you may grant certain permissions for Mondosa Motors LLC to obtain information from your smart device such as your location and access to your device’s camera or photos. Please consult your device manufacturer for information on how to view or modify these permissions, but note that doing so may limit the functionality of Application features.

Information We Collect Automatically

Tracking Technologies

We use cookies and other tracking technologies to personalize your experience, analyze user trends, and improve the Mondosa Motors LLC Platform. These tracking technologies allow us to collect information such as your device type, browser type, time spent on our websites, pages visited, geographic location, and other data. Information Sharing

Inquiries

When you complete the “Contact a Dealership,” "Auto Finder", “Schedule a Test Drive,” or “Request a Quote,” forms, we share this information with authorized staff so they can contact you about your request and provide you with information about services and products that may meet your needs. When you complete the “Apply for Credit” form, your information is shared with our partners to provide Financial Services so they can review your credit application. 

Sweepstakes, Promotions, Contests & Surveys

We use third party service providers to manage Mondosa Motors LLC Platform-based sweepstakes, promotions, and contests, and to conduct surveys about your experience using the Mondosa Motors LLC Platform. When you enter sweepstakes, promotions, and contests or complete surveys on the Mondosa Motors LLC Platform, your information is shared with our service providers.

Placing an Order

We use a third party service provider to manage our Lifestyle Collection website and to manage deposit payments when you reserve a vehicle. Information you provide when making online purchases is shared with our third party service providers so that your payment can be processed and your order can be fulfilled.

Account Registration

When you register an account on the Mondosa Motors LLC Platform, Mondosa Motors LLC does not maintain your password.

The Mondosa Motors LLC Platform contains links to other websites such as social media platforms, other Mondosa Motors LLC websites, and event and partner websites. If you believe your child has impermissibly provided us with their personal information, please contact us, so that we can identify and delete their information.
